Information on the collection of personal data and provider labelling

  1. Below we provide information about the collection of personal data when using our Instagram page. Instagram is a product of Meta Platforms Ireland Ltd, 4 Grand Canal Square Grand Canal Harbour, Dublin 2, Ireland. Personal data is all data that can be related to you personally, e.g. name, address, email addresses, user behaviour.
  2. Joint controllers pursuant to Art. 26 para. 1 in conjunction with Art. 4 para. 7 EU Data Protection Regulation. Art. 4 para. 7 EU General Data Protection Regulation (GDPR) are:

  3. If we use contracted service providers for individual functions of our offer or would like to use your data for advertising purposes, we will inform you in detail below about the respective processes. In doing so, we will also state the specified criteria for the storage period.

Rights, in particular to information and cancellation

  1. You have the following rights vis-à-vis us with regard to your personal data:
    • Right of access,
    • Right to rectification or erasure,
    • Right to restriction of processing,
    • Right to object to processing,
    • Right to data portability.
  2. If you have given your consent to the use of data, you can revoke this at any time. If the lawfulness of the processing is based on consent, this remains valid until the revocation is exercised.

Information about our Instagram page

  1. We operate this page to draw attention to our educational work, services and products in the field of Holocaust education for young people and to get in touch with you as a visitor and user of this Facebook page. Further information about us and our activities, companies etc. can be found on our website at zweitzeugen.de.
  2. The operation of this Instagram page, including the processing of users' personal data, is based on our legitimate interests in a contemporary and supportive information, interaction and advertising opportunity for and with our users and visitors in accordance with Art. 6 para. 1 lit. f. GDPR. GDPR.
  3. You can object to this processing at any time in accordance with Art. 21. However, there may be reasons why it is not possible to erase your data.
     

 

Collection of personal data by Instagram

  1. In its judgement of 5 June 2018, the European Court of Justice (ECJ) ruled http://curia.europa.eu/juris/document/document.jsf?text=&docid=202543&pageIndex=0&doclang=DE&mode=req&dir=&occ=first&part=1&cid=298398 that the operator of an Instagram page is also jointly responsible with Facebook (now Meta Platforms) for the processing of personal data.
  2. When you visit our Instagram page, Meta Platforms collects, among other things, your IP address and other information that is stored on your PC in the form of cookies. This information is used to provide us, as the operator of the Instagram pages, with statistical information about the use of the Instagram page.   3. The data collected about you in this context will be processed by Meta Platforms Ireland Ltd. and may be transferred to countries outside the European Union. What information Meta Platforms receives and how it is used is described by Meta Platforms in general terms in its data usage guidelines. Meta Platforms does not conclusively and clearly state how Meta Platforms uses the data from visits to Instagram pages for its own purposes, to what extent activities on the Instagram page are assigned to individual users, how long Meta Platforms stores this data and whether data from a visit to the Instagram page is passed on to third parties, and we are not aware of this.
  5. When you access an Instagram page, the IP address assigned to your device is transmitted to Meta Platforms. According to Meta Platforms, this IP address is anonymised (for ‘German’ IP addresses) and deleted after 90 days. Meta Platforms also stores information about the end devices of its users (e.g. as part of the ‘login notification’ function); Meta Platforms may thus be able to assign IP addresses to individual users.
  6. If you are currently logged in to Facebook as a user, a cookie with your Instagram ID is stored on your device. This enables Meta Platforms to track that you have visited this page and how you have used it. This also applies to all other Instagram pages. Instagram buttons integrated into websites enable Meta Platforms to record your visits to these websites and assign them to your Instagram profile. This data can be used to offer you customised content or advertising.
  7. If you want to avoid this, you should log out of Instagram or deactivate the ‘stay logged in’ function, delete the cookies on your device and close and restart your browser. This will delete Instagram information that can be used to directly identify you. This allows you to use our Instagram page without revealing your Instagram ID. If you access interactive functions on the site (like, comment, share, message, etc.), an Instagram login screen will appear. Once you have logged in, Meta Platforms will again recognise you as a specific user.

Meta Platforms Ireland ensures a comparable level of data protection when transferring data to the parent company in the USA by concluding so-called standard contractual clauses (SCC) in accordance with Art. 46 para. 2 GDPR.   12. The transfer and further processing of users' personal data to third countries, such as the USA, and the associated potential risks for users cannot be ruled out by us as the operator of the site.

Collection when you contact us

  1. When you contact us by e-mail or via the contact form, we will store your e-mail address, your name and, if you specify this, your telephone number. The purpose of this storage is merely to contact you in order to answer your questions.
  2. The legal basis for the stated collection is the consent that you have given by visiting our Instagram fan page and sending an email or sending the contact form (Art. 6 para. 1 lit. a GDPR).

Survey for statistical purposes by us

  1. We can access statistical data of various categories via the so-called ‘Insights’ on the Instagram page. These statistics are generated and provided by Meta Platforms. As the operator of the site, we have no influence on the generation and presentation of this data. We cannot switch off this function or prevent the generation and processing of the data. Meta Platforms provides us with the following data relating to our Instagram page for a selectable period of time and for the categories fans, subscribers, people reached and people interacting:
    1. Total number of page views,
    2. ‘Like’ information,
    3. Page activities,
    4. Post interactions,
    5. reach,
    6. video views,
    7. post reach,
    8. comments,
    9. Shared content,
    10. replies,
    11. Proportion of men and women,
    12. Origin in relation to country and city,
    13. language,
    14. views and clicks in the shop,
    15. clicks on route planners,
    16. clicks on telephone numbers.
  2. Data on the Instagram groups linked to our Instagram page is also provided in this way. Due to the constant development of Meta Platforms, the availability and processing of the data changes, so we refer you to the above-mentioned Meta Platforms privacy policy for further details.
  3. We use this data, which is available in aggregated form (no direct personal reference possible), to make our posts and activities on our Instagram page more attractive to users. For example, we use the distribution by age and gender for a customised approach and the preferred visiting times of the users for a time-optimised planning of our posts. Information about the type of devices used by visitors helps us to adapt the visual design of our posts accordingly. In accordance with the Instagram terms of use, which every user has agreed to when creating an Instagram profile, we can identify subscribers and fans of the site and view their profiles and other information shared by them.
  4. We base the processing of statistical data to improve our application on Art. 6 para. 1 lit. f GDPR and our legitimate interest in advertising our products as an expression of (professional and entrepreneurial freedom Art. 15 para. 1 and Art. 16 GDPR).
  5. You can object to this processing at any time in accordance with Art. 21. However, there may be reasons why it is not possible to erase your data.

Cookies

  1. In addition to the aforementioned data, cookies are stored on your computer when you use our website. Cookies are small text files that are stored on your hard drive assigned to the browser you are using and through which certain information flows to the organisation that sets the cookie (in this case, us). Cookies cannot execute programmes or transfer viruses to your computer. They are used to make the website more user-friendly and effective overall.
